{"id":719,"date":"2014-10-02T09:21:21","date_gmt":"2014-10-02T09:21:21","guid":{"rendered":"http:\/\/seafarersrights-over.temp-dns.com\/?p=719"},"modified":"2014-10-02T09:21:21","modified_gmt":"2014-10-02T09:21:21","slug":"flag-state-responsibilities","status":"publish","type":"post","link":"https:\/\/seafarersrights.org\/flag-state-responsibilities\/","title":{"rendered":"Flag state responsibilities"},"content":{"rendered":"<p>Under the Maritime Labour Convention 2006 (\u2018MLC\u2019):<\/p>\n<ul>\n<li>Each flag state must have an inspection system to ensure that its ships meet the requirements of the MLC.<\/li>\n<\/ul>\n<ul>\n<li>After a successful inspection the ship will be given a Maritime Labour Certificate and a Declaration of Maritime Labour Compliance which lists the way in which the country\u2019s laws comply with the MLC and sets out how the ship complies with those laws.<\/li>\n<\/ul>\n<ul>\n<li>The following areas need to be inspected the flag state:\n<ul>\n<li>minimum age;<\/li>\n<li>medical certification;<\/li>\n<li>qualification of seafarers;<\/li>\n<li>use of private recruitment agencies;<\/li>\n<li>work and rest hours;<\/li>\n<li>manning levels;<\/li>\n<li>accommodation;<\/li>\n<li>recreational facilities;<\/li>\n<li>food and catering;<\/li>\n<li>health and safety;<\/li>\n<li>medical care;<\/li>\n<li>complaints procedures; and<\/li>\n<li>payment of wages.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li>A current valid certificate must be posted on board a ship for the seafarer to read.<\/li>\n<\/ul>\n<ul>\n<li>If a complaint is received about a ship, it must be investigated by the flag state.<\/li>\n<\/ul>\n<ul>\n<li>If a flag inspector finds a serious breach of the MLC, he may stop the ship leaving port.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>See Regulation 5.1 of the MLC.<\/p>\n<p><strong>For more information<\/strong><\/p>\n<p>See the ILO Frequently Asked Questions (section C5.2) at <a title=\"Port state responsibilities\" href=\"http:\/\/www.ilo.org\/global\/standards\/maritime-labour-convention\/what-it-does\/faq\/WCMS_177371\/lang--en\/index.htm\" target=\"_self\">http:\/\/www.ilo.org\/global\/standards\/maritime-labour-convention\/what-it-does\/faq\/WCMS_177371\/lang&#8211;en\/index.htm<\/a><\/p>\n<p>&nbsp;<\/p>\n<p>July 2014<\/p>\n ","protected":false},"excerpt":{"rendered":"<p>Under the Maritime Labour Convention 2006 (\u2018MLC\u2019): Each flag state must have an inspection system to ensure that its ships meet the requirements of the MLC.
