{"id":695,"date":"2014-10-02T09:13:14","date_gmt":"2014-10-02T09:13:14","guid":{"rendered":"http:\/\/seafarersrights-over.temp-dns.com\/?p=695"},"modified":"2014-10-02T09:13:14","modified_gmt":"2014-10-02T09:13:14","slug":"right-to-leave","status":"publish","type":"post","link":"https:\/\/seafarersrights.org\/right-to-leave\/","title":{"rendered":"Right to leave"},"content":{"rendered":"<p>Under the Maritime Labour Convention 2006 (\u2018MLC\u2019):<\/p>\n<ul>\n<li>A seafarer has the right to paid annual leave.<\/li>\n<\/ul>\n<ul>\n<li>Subject to operational requirements, seafarers must also be given shore leave.<b><\/b><\/li>\n<\/ul>\n<ul>\n<li>Annual leave with pay is calculated on the basis of 2.5 days for every calendar month of employment.\u00a0 This is a minimum entitlement and if the employment agreement or the collective bargaining agreement provides for a higher rate of paid annual leave, then this higher rate is applicable.<b><\/b><\/li>\n<\/ul>\n<ul>\n<li>If a seafarer\u2019s employment is shorter than, or terminates part way through the year, his leave entitlement must be calculated on a pro-rata basis.<\/li>\n<\/ul>\n<ul>\n<li>Unauthorised agreements to the effect of denying or buying off the minimum annual leave with pay are not allowed.<b><\/b><\/li>\n<\/ul>\n<ul>\n<li>The following should not be counted as part of annual leave with pay:\n<ul>\n<li>public and customary holidays recognised in the flag state;<\/li>\n<li>time off for illness, injury or maternity;<\/li>\n<li>temporary shore leave;<\/li>\n<li>compensatory leave; or<\/li>\n<li>other justified absences.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li>A seafarer must be able to take his annual leave in his home country or another place with which he has a substantial connection.
