{"id":689,"date":"2014-10-02T09:11:16","date_gmt":"2014-10-02T09:11:16","guid":{"rendered":"http:\/\/seafarersrights-over.temp-dns.com\/?p=689"},"modified":"2014-10-02T09:11:16","modified_gmt":"2014-10-02T09:11:16","slug":"right-to-employment-agreement","status":"publish","type":"post","link":"https:\/\/seafarersrights.org\/right-to-employment-agreement\/","title":{"rendered":"Right to employment agreement"},"content":{"rendered":"<p>Under the Maritime Labour Convention 2006 (\u2018MLC\u2019):<\/p>\n<ul>\n<li>A seafarer has the right to a written employment agreement. It must be clear and legally enforceable.<\/li>\n<li>A seafarer must be able to review the employment agreement, and seek advice on it, before signing it.<\/li>\n<li>A seafarer must enter into the employment agreement freely.<\/li>\n<li>The employment agreement must be signed by the seafarer and the shipowner, or a representative of the shipowner.<\/li>\n<li>The seafarer and the shipowner must each have a signed original of the employment agreement.<\/li>\n<li>If the employment agreement includes a collective bargaining agreement, a copy of the collective agreement must be available on board the ship.<\/li>\n<li>The employment agreement must contain the following particulars:<\/li>\n<li>the seafarer\u2019s full name, date of birth or age, and birthplace;<\/li>\n<li>the shipowner\u2019s name and address;<\/li>\n<li>the place where and date when the employment agreement is entered into;<\/li>\n<li>the seafarer\u2019s position on board;<\/li>\n<li>the amount of the seafarer\u2019s wages, or how they are calculated;<\/li>\n<li>the amount of annual paid leave, or how it is calculated;<\/li>\n<li>the conditions for terminating the agreement, including the notice period, if the agreement is for an indefinite period (this must not be less for the shipowner than for the seafarer); the expiry date, if the agreement is for a fixed term; and the port of destination, if the agreement is for a specific voyage;<\/li>\n<li>the health and social security protection benefits provided by the shipowner;<\/li>\n<li>the seafarer\u2019s entitlement to repatriation;<\/li>\n<li>reference to the collective bargaining agreement, if applicable.<\/li>\n<li>A copy of the seafarer\u2019s employment agreement, including any applicable collective bargaining agreement, must be available substantively in English on board the ship for review by officers of a competent authority, including port state control officers.<\/li>\n<\/ul>\n<p>See Regulation 2.1 of the MLC.<\/p>\n<p><strong>For more information<\/strong><\/p>\n<p>See the ILO Frequently Asked Questions (section C5.2) at <a title=\"Port state responsibilities\" href=\"http:\/\/www.ilo.org\/global\/standards\/maritime-labour-convention\/what-it-does\/faq\/WCMS_177371\/lang--en\/index.htm\" target=\"_self\">http:\/\/www.ilo.org\/global\/standards\/maritime-labour-convention\/what-it-does\/faq\/WCMS_177371\/lang&#8211;en\/index.htm<\/a><\/p>\n<p>&nbsp;<\/p>\n<p>July 2014<\/p>\n ","protected":false},"excerpt":{"rendered":"<p>Under the Maritime Labour Convention 2006 (\u2018MLC\u2019): A seafarer has the right to a written employment agreement.
