{"id":683,"date":"2014-10-02T09:08:55","date_gmt":"2014-10-02T09:08:55","guid":{"rendered":"http:\/\/seafarersrights-over.temp-dns.com\/?p=683"},"modified":"2014-10-02T09:08:55","modified_gmt":"2014-10-02T09:08:55","slug":"requirement-to-be-medically-fit","status":"publish","type":"post","link":"https:\/\/seafarersrights.org\/requirement-to-be-medically-fit\/","title":{"rendered":"Requirement to be medically fit"},"content":{"rendered":"<p>Under the Maritime Labour Convention 2006 (\u2018MLC\u2019):<\/p>\n<ul>\n<li>A seafarer cannot work on a ship unless he holds a valid medical certificate stating that he is medically fit to perform the duties he is to carry out at sea.<\/li>\n<\/ul>\n<ul>\n<li>A country that has ratified the MLC must set out the medical examination and certificate that is needed. The certificate must:\n<ul>\n<li>be in English if the ship does international voyages;<\/li>\n<li>be issued by a duly qualified medical practitioner. (Each country will decide who is qualified for this purpose, but practitioners must have professional independence); and<\/li>\n<li>be valid.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li>Unless a shorter period is required, the maximum period of validity for a certificate is:\n<ul>\n<li>two years &#8211; except for seafarers under 18: then it is one year<\/li>\n<li>six years for a colour vision certificate.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li>If a certificate is refused, or limited, a seafarer can have a further examination by another independent medical practitioner, or by an independent medical referee.<\/li>\n<\/ul>\n<ul>\n<li>There is a procedure for urgent cases which allows the seafarer to carry on working for a short time with an expired medical certificate.<\/li>\n<\/ul>\n<ul>\n<li>A medical certificate issued in accordance with the requirements of the International Convention on Standards of Training, Certification and Watchkeeping for Seafarers 1978, as amended, will be acceptable.<\/li>\n<\/ul>\n<p>See Regulation 1.2 of the MLC.<\/p>\n<p><strong>For more information<\/strong><\/p>\n<p>See the ILO Frequently Asked Questions (section C5.2) at <a title=\"Port state responsibilities\" href=\"http:\/\/www.ilo.org\/global\/standards\/maritime-labour-convention\/what-it-does\/faq\/WCMS_177371\/lang--en\/index.htm\" target=\"_self\">http:\/\/www.ilo.org\/global\/standards\/maritime-labour-convention\/what-it-does\/faq\/WCMS_177371\/lang&#8211;en\/index.htm<\/a><\/p>\n<p>&nbsp;<\/p>\n<p>July 2014<\/p>\n ","protected":false},"excerpt":{"rendered":"<p>Under the Maritime Labour Convention 2006 (\u2018MLC\u2019): A seafarer cannot work on a ship unless he holds a valid medical certificate stating that he is medically fit to perform the duties he is to carry out at sea.
