{"id":21176,"date":"2019-07-10T11:23:39","date_gmt":"2019-07-10T10:23:39","guid":{"rendered":"https:\/\/seafarersrights.org\/?p=21176"},"modified":"2019-07-10T11:26:32","modified_gmt":"2019-07-10T10:26:32","slug":"uae-to-overhaul-maritime-laws-to-protect-seafarers","status":"publish","type":"post","link":"https:\/\/seafarersrights.org\/uae-to-overhaul-maritime-laws-to-protect-seafarers\/","title":{"rendered":"UAE to Overhaul Maritime Laws to Protect Seafarers"},"content":{"rendered":"<figure id=\"attachment_21178\" aria-describedby=\"caption-attachment-21178\" style=\"width: 267px\" class=\"wp-caption alignright\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-21178 size-medium\" src=\"\/wp-content\/uploads\/2019\/07\/New-Maritime-Law-UAE-267x300.jpg\" alt=\"\" width=\"267\" height=\"300\" srcset=\"https:\/\/seafarersrights.org\/wp-content\/uploads\/2019\/07\/New-Maritime-Law-UAE-267x300.jpg 267w, https:\/\/seafarersrights.org\/wp-content\/uploads\/2019\/07\/New-Maritime-Law-UAE-24x27.jpg 24w, https:\/\/seafarersrights.org\/wp-content\/uploads\/2019\/07\/New-Maritime-Law-UAE.jpg 597w\" sizes=\"auto, (max-width: 267px) 100vw, 267px\" \/><figcaption id=\"caption-attachment-21178\" class=\"wp-caption-text\">Dr Abdullah Al Nuaimi, Minister of Infrastructure Development, UAE.<\/figcaption><\/figure>\n<p>The UAE will introduce tough rules to protect abandoned seafarers, clamp down on ghost ships in its waters and allow 100 per cent foreign ownership of maritime companies.<\/p>\n<p>The new measures, are part of the UAE\u2019s draft maritime law, which is set to come into force by early next year.<\/p>\n<p>It will also allow people to register vessels under the Emirati flag and establish a new dispute mechanism to relieve pressure on the courts, while a new maritime development fund aims to support citizens who wish to invest in the sector.<\/p>\n<p>A \u201cmaritime navigation chamber\u201d to represent the interests of the private sector will also be formed.<\/p>\n<p>Full foreign ownership of companies will apply only in certain cases, however, and will be Dr Abdullah Al Nuaimi, Minister of Infrastructure Development,\u00a0That stipulated that a final decision on the percentage of foreign ownership rests with each emirate.<\/p>\n<p>Abdullah Al Nuaimi, Minister of Infrastructure Development, said more details about the law would be revealed in the coming months and that it has been in the works for the past two years.<\/p>\n<p>The \u201cnew maritime bill\u201d will completely overhaul the 1981 law, which he said was sorely in need of updating.<\/p>\n<p>\u201cSince then the law has moved on,\u201d said Mr Al Nuaimi, who is also chairman of the Federal Transport Authority-Land and Maritime.<\/p>\n<p>The issue of abandoned vessels and the plight of sailorDr Abdullah Al Nuaimi, Minister of Infrastructure Development,t three years on the vessels and suffered financial loss and severe psychological stress.<\/p>\n<p>Authorities had already bolstered existing shipping regulations, such as banning tankers that are more than 25 years old from UAE waters and ensuring shipping operators have insurance to cover crew salaries for up to four months. But the new federal law will hand stronger powers to maritime chiefs and the country\u2019s ports to combat the problem.<\/p>\n<div class=\"simplebox\">\n<div class=\"simplebox-content\">\n<p>\u201cI feel two things with regard to the issues of abandoned vessels \u2013 pride and sorrow,\u201d Mr Al Nuaimi said. \u201cI feel pride that [the UAE] is a haven for these ships \u2013 they didn\u2019t come here by accident.\u201d<\/p>\n<\/div>\n<\/div>\n<p>Mr Al Nuaimi said these cases were sad for the sailors involved.<\/p>\n<p>He also said the new law would clamp down on abandoned vessels by handing stronger powers to maritime chiefs and the country\u2019s ports to combat the problem.<\/p>\n<p>It would also enshrine the rights of sailors in law, Mr Al Nuaimi said.<\/p>\n<p>\u201cWe are an open country and deal with trade in a civil way that you might not find in other places,\u201d he said.<\/p>\n<p>The new law will also update rules on insurance and collisions at sea, among other matters. Mr Al Nuaimi said it was important the law was malleable and could be changed or altered in the future.<\/p>\n<p>\u201cThis law will be able to absorb the challenges of the future and be a capable addition to the maritime transport here in UAE.\u201d<\/p>\n<p>Rev Andy Bowerman, from the Mission to Seafarers, which takes supplies to stranded sailors, said current legislation has allowed disputes to run on for too long.<\/p>\n<p>\u201cWe welcome any move by the UAE to protect those who work at sea,\u201d he said. \u201cBut it is imperative that any legislation prioritises the seafarers rather than owners of the ships.\u201d<\/p>\n<p>\u201cIt is possible this could be done in a matter of days rather than months as is often the case,\u201d he said.<\/p>\n<p>\u201cIt will be interesting to see how quickly it [the new law] comes into force and then how successful it is in bringing prosecutions as well as protection for the seafarers.\u201d<\/p>\n<div class=\"align-left\">\n<p class=\"last-updated\">With thanks to <a href=\"https:\/\/www.thenational.ae\/uae\/government\/uae-to-overhaul-maritime-laws-to-protect-sailors-and-allow-foreign-ownership-1.883491\">The National<\/a><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignleft wp-image-21177 \" src=\"\/wp-content\/uploads\/2019\/07\/National-logo-300x123.png\" alt=\"\" width=\"134\" height=\"55\" \/><\/p>\n<p>&nbsp;<\/p>\n<\/div>\n ","protected":false},"excerpt":{"rendered":"<p>The UAE will introduce tough rules to protect abandoned seafarers, clamp down on ghost ships in its waters and allow 100 per cent foreign ownership of maritime companies.
